supertanker has neither the physical ability, nor the legal desire, to
touch land.” The court dismissed, for lack of personal jurisdiction, the claim
of the plaintiff captain, who alleged that he had sustained a personal injury
while working 50 miles offshore in the Gulf of Mexico to help unload a
supertanker owned by a foreign corporation with its principal place of business
in Switzerland.
Tamara A.D. Hodge, from Victoria County, and Jamie Lalonde, from
Kootenay County, were recently appointed as the CBABC representatives
on the CBA Provincial Council, each for three-year terms.
In Ingram v. Bowers, 47 F.2d 925 (1931), the U.S. District Court for the Southern
District of New York considered an action for reimbursement of certain
income taxes paid under protest by the plaintiff as ancillary administratrix
of Enrico Caruso. The court provided a helpful biography:
Caruso was the foremost singer of the world. His fame was international,
although the greater part of his singing during the last ten years of his life
was done in the United States. He was born in Italy and always remained
a subject of that country. For many years prior to his death in 1921, he
spent about six months of the year in the United States, singing at the
Metropolitan Opera House in New York City and giving concerts at other
cities. At the close of the operatic season, he almost always returned to
Italy, where he maintained a large estate. His headquarters in the United
States were the Knickerbocker Hotel, New York City, where he leased a
suite of rooms, and later the Vanderbilt Hotel here …
In Midway Airlines, Inc., v. Northwest Airlines, Inc., 6 F.3d 492 (1993), the U.S.
Court of Appeals for the Seventh Circuit noted that “had MAC contracted
with Luciano Pavarotti to sing in its passenger facilities in order to soothe
the souls of weary travelers, it could not be compelled to accept performance
from pop-star Michael Jackson in the event of the great tenor’s bankruptcy.”
