In the copyright context, the U.S. District Court for the Eastern District of
Missouri noted that “it is the aria from Puccini as sung by Pavarotti at
Kennedy Center and the performance of Aida at the Metropolitan and the
football game between the Cardinals and another team that the television
viewers take delight in and not the inserted commercials”: National Football
