THE ADVOCATE 793
VOL. 79 PART 5 SEPTEMBER 2021
Epstein explained, the plaintiff’s claims “all centre on his firm assertion that
he is not a human being; rather a martian”; he complained that “the numerous
defendants who include a number of doctors, medical facilities and government
agencies” had “conspired with the American government in its
attempts to eliminate him and have otherwise taken various steps to interfere
with his ability to establish himself and live freely as a martian.” (The
plaintiff advised the court he had recently commenced an additional action
against, among others, the Central Intelligence Agency, for interfering with
his DNA test results that proved that he was, in fact, not human.) The court
identified as one of the reasons why the statements of claim should be
struck and the actions dismissed that “neither pleading discloses a cause
of action”. In this regard:
While conspiracy to do harm to someone is the basis of many actions in
this Court there is a fundamental flaw in the position of Mr. Joly. Rule
1.03 defines plaintiff as “a person who commences an action”. The New
Shorter Oxford English Dictionary defines person as “an individual
human being”. Section 29 of the Interpretation Act provides that a person
includes a corporation. It follows that if the plaintiff is not a person in that
he is neither a human being nor a corporation, he cannot be a plaintiff as
contemplated by the Rules of Civil Procedure. The entire basis of Mr.
Joly’s actions is that he is a martian, not a human being. There is certainly
no suggestion that he is a corporation. I conclude therefore, that
Mr. Joly, on his pleading as drafted, has no status before the Court.

Justice F.L. Myers remarked in Apotex Inc. v. Eli Lilly and Company, 2017
ONSC 7204 that “unless or until the court determines that the parties have
consumed more than their fair share of scarce public resources, their battles
appear to be destined to continue as unrelenting as the 500 year war
between Eminiar VII and Vendikar “A Taste of Armageddon”, Star Trek, Season
1, Episode 23, NBC, February 23, 1967”.
Bailey A.J. Savage and Cristen L. Gleeson were appointed to the board of

Not out of this world, British Columbia has its own planetary features.
There is a Mars Creek that flows into Lake Revelstoke and a Mars Island in
the Broughton Archipelago. Further up the coast, Mercury Islet can be
found. Jupiter is honoured with a Jupiter Creek, a Jupiter Island (in Hakai
Passage) and Mount Jupiter in Glacier National Park. Not to be outdone,
Pluto (a dwarf planet) also makes an appearance with a Pluto Peak towering
